Notice of Public Hearing: Functional Foods

Kelley Drye Client Advisory

On October 20, 2006, the Food and Drug Administration (“FDA”) issued a notice of public hearing on foods being marketed as functional foods.” The meeting will take place at 9 a.m. on December 5, 2006, in College Park, Maryland.

This public hearing is part of an agency effort to initiate industry discussion and solicit comments on formulating guidelines specifically tailored to the regulation of functional foods. FDA currently regulates functional foods under the same regulatory framework as conventional foods, but is recognizing the importance of establishing specific regulations for this growing subset of foods.
