Associate Katie Townley co-authored the E-Commerce Law & Policy article, The FTC’s Revised Guidelines on Disclosures in Digital Ads.” Last month, the Federal Trade Commission (“FTC”) released revisions to its guidance document on disclosures in digital advertising. “.com Disclosures: How to Make Effective Disclosures in Digital Advertising” expands on the FTC’s prior guidance, Dot Com Disclosures: Information About Online Advertising,” released in 2000. The article discusses the updates to the Revised Guide, which addresses recent changes in technology. In light of the Revised Guide, the FTC will likely increase its review of digital advertising disclosures and bring enforcement actions when it believes that an advertiser has violated the FTC Act or any Commission rules.
