Organizational Conflicts of Interest at the Federal, State, and Local Levels

Kelley Drye Government Contracts attorney, Ken Kanzawa, and his co-author Danica Irvine, senior attorney with the Department of Defense General Counsel’s Standards of Conducts Office, published this article examining an important issue in public contracting: organizational conflicts of interest, or “OCI’s”. Laws and policies governing OCIs play a significant role in maintaining the integrity and fairness of the procurement process. This article summarizes OCI requirements under the Federal Acquisition Regulation (FAR); compares FAR-based requirements with laws and regulations on OCIs for grants and other non-procurement programs; addresses personal conflicts of interest under federal law; and reviews OCI policies from several states and localities.
