Litigation Won’t Cure America’s Opioid Epidemic

Partners William Escobar, Neil Merkl and Clifford Katz authored the New York Law Journal article Litigation Won’t Cure America’s Opioid Epidemic.” The article argues that the use of civil suits to combat the Opioid Epidemic is not a proper function of the justice system and diverts attention from the need for properly targeted public policy solutions. The authors analyze the background and causes of action alleged in more than 200 lawsuits filed by states and municipalities against opioid distributors and manufacturers in the United States and conclude that these cases distort the law and do not address the actual crisis.
