Your brand and your reputation are on the line, and compliance with safety standards is essential. To do this, you need a partner who knows the regulatory environment and can stand with you every step of the way.
Our consumer products safety team protects our clients’ brands by ensuring they meet applicable federal and state safety standards.
We will help you develop internal programs to avoid risk. And when you need to respond to incident investigations and issues involving potential hazards or product defects, we act quickly and discreetly before they escalate, safeguarding your business’s reputation with consumers and regulators.
We work with clients—Fortune 500 companies and global manufacturers, distributors, and retailers—on a wide range of consumer product safety issues, from designing internal compliance programs, to counseling on reporting obligations, to guiding on corrective actions such as incident investigation and recalls.
We develop and implement internal compliance programs to reduce risk and advise on difficult issues of how and when potentially hazardous consumer products must be reported to the Consumer Product Safety Commission (CPSC).
We also advise on the impact of the information-sharing agreement between CPSC and U.S. Customs and Border Protection, in which the parties agreed to share information about the safety of consumer products imported into the United States. We’ll help you stay in compliance with procedures under this agreement and secure the release of goods that may be detained at the Commercial Targeting and Analysis Center.
We counsel businesses on new and changing regulations including those enforced by CPSC, the Food and Drug Administration, and the Federal Trade Commission, and how to comply with warnings and labeling standards. We help brands in participating in voluntary and mandatory industry-wide standards and advocate on behalf of clients in connection with proposed changes in standards.
Our team counsels on federal and state chemical regulations, such as the Toxic Substances Control Act, California Proposition 65, and similar programs that impose bans, reporting mandates, and labeling requirements. We are adept at analyzing toxicological data and developing compliance programs to help clients keep pace with the ever-expanding scope of chemical and product regulations.
Potential product-safety issues often require immediate action. We respond quickly, with right-sized teams of attorneys drawn from multiple disciplines across the firm, to provide complete representation and resourceful, strategic counsel.
Our attorneys evaluate and respond to consumer incident reports, including those submitted to the CPSC SaferProducts.gov database and, in the event of a product recall, collaborate with clients and CPSC staff to develop and implement cost-effective communications programs to satisfy product liability concerns quickly.
Throughout any evaluation of a potential safety issue, we provide effective defense strategies that protect corporate interests and preserve business momentum.
