Ken Kanzawa draws on insider experience and perspective honed as a NASA attorney to assist clients with high stakes government contracts litigation and counseling matters.

Ken helps clients on a range of issues, including bid protests, contract disputes, subcontract negotiation and teaming agreements, domestic sourcing restrictions, small business contracting, GSA schedule, debarment and suspension, and other compliance issues. He regularly appears before the GAO, Court of Federal Claims, Boards of Contract Appeals, and suspension and debarment officials.

In addition, Ken helps clients conduct due diligence for mergers and acquisitions across industries including government IT solutions, cybersecurity, professional consulting, and health care. He helps clients negotiate terms of Defense Production Act awards to expand domestic industrial capacity. And clients turn to Ken to draft legislative solutions for introduction by the House and Senate.

While at NASA, Ken handled bid protests of major procurements, including a mission systems contract valued at more than $1 billion. He counseled on contract performance disputes and advised NASA’s suspending and debarring official. Ken also served on the Federal Acquisition Regulatory Council, assisting with regulatory drafting and the implementation of federal procurement policy.

Ken currently serves as a co-chair of the ABA Debarment and Suspension Committee and a vice chair of the ABA Bid Protest Committee.

Successfully protested the Naval Facilities Engineering Command’s (NAVFAC’s) evaluation and awards of multiple IDIQ contracts for marine and land construction before the Government Accountability Office (GAO), resulting in a contract award and protest costs for the client.

Successfully protested the Centers for Disease Control and Prevention’s award of contracts before the GAO, resulting in a contract award for the client to perform international global health support services work.

Successfully protested the Department of Interior, Bureau of Reclamation’s award of IDIQ contracts for architect-engineer services before the GAO, resulting in a contract award for the client.

Successfully protested to GAO the Department of Interior’s decision not to award consulting firm an IDIQ contract to perform logistical support services for the Department of Health and Human Services, resulting in a contract award for the client.

Successfully protested to the Court of Federal Claims the U.S. Department of Veterans Affairs’ award of home oxygen contracts, resulting in termination of the awardee’s contracts and issuance of a bridge contract to client.

Successfully protested at the agency level a U.S. Department of Veterans Affairs task order award for laboratory testing services, resulting in revision and reissuance of the solicitation.

Successfully protested the Army’s decision to eliminate a client from eligibility for a contract for C4ISR services before the GAO, resulting in a contract award and protest costs for the client.

Successfully defended the award of a U.S. Transportation Security Administration contract to an airport security screening contractor at the GAO.

Obtained favorable outcome prediction ADR at GAO in protest of Smithsonian Institution’s award, resulting in payment of attorneys’ fees, reevaluation, and eventual award.

Obtained favorable outcome prediction ADR at GAO in protest of U.S. Army Corps of Engineers’ selection of a competitor for architect-engineer negotiations, resulting in payment of legal fees for the client.

Obtained favorable settlement of performance dispute involving environmental remediation contract with U.S. Army Corps of Engineers, through mediation at Armed Services Board of Contract Appeals.

Prepared terms of a major subcontract to resolve the prospect of continued litigation between two medical waste disposal firms.

Advised clients during acquisitions of companies in industries including government IT solutions, cybersecurity, professional consulting, and healthcare.

Assisted client with negotiating terms of Defense Production Act award for expansion of domestic industrial capacity.

Drafted procurement legislation on behalf of construction and engineering clients that was introduced in both the House and Senate.
