Law360 Reports on Kelley Drye’s Successful Dismissal of a Proposed TCPA Class Action Against Kohl’s Corporation

Mazzuchetti are mentioned as counsel to Kohl’s Corp. in the Law360 article, ​“Kohl’s Escapes Class Action Over Unwanted Phone Calls,” regarding the dismissal of a proposed class action accusing the department store chain of violating the Telephone Consumer Protection Act (TCPA).   U.S. District Judge William Conley rejected the plaintiff’s complaints that she had been receiving unsolicited phone calls after signing up for a Kohl’s credit card because the claims were covered in the cardmember agreement. The Court determined that plaintiff assented to binding arbitration, and granted Kohl’s motion to arbitrate her individual claim and dismissed the action.
