Kelley Drye is currently representing software developer LimitNone in a $950 million trade secret lawsuit filed against Google, Inc. in the Circuit Court of Cook County, Illinois.
From the Chicago office, Kelley Drye partners David A. Rammelt and Susan J. Greenspon are representing LimitNone. The complaint asserts that Google misappropriated LimitNone's trade secrets when it obtained confidential access to, and then copied, a proprietary software program developed by LimitNone, a small technology company.
At Google's urging and with the company's express promise that it would not develop a competing product, LimitNone spent almost a year testing, refining and presenting to Google's staff and potential customers a product called gMove, a software tool for migrating employees' email, calendar and contact information from Microsoft's "Office" suite of business applications to Google's competing product, Google Apps.
LimitNone alleges that, on the eve of the release of gMove version 2.0 Google, for the first time, informed LimitNone that it would be coming out with its own competitive program, the "Google Email Uploader." LimitNone alleges that Google's software program is essentially identical to LimitNone's product and that Google could not have developed its competing product without using the information it
learned from having access to and studying LimitNone's confidential and proprietary program. The complaint alleges that Google's own executives predicted that the migration tool would have "50 million users," which in the end proved to great a temptation for Google. In addition to Mr. Rammelt and Ms. Greenspon, associates Caroline C. Plater and Matthew C. Luzadder are working on this case.
